Call for Delegates!

In order to properly restore the original legitimate American government at the point when it was still legitimate, before it went wrong, obviously we have to restore it at its previous state. As mentioned on our home page, the 1st logical checkpoint was just before the Constitution was adopted, when we were still operating legally under the Articles of Confederation. If I remember correctly, we still had only the original 13 colonies at that time and had not added any new states. Even if we had, the original 13 would still make a better than 3/4 majority. So we need at least 1 delegate from each of the original 13 colonies. Based on the Articles, it looks like we need 9 at the very least.

Although we have not yet precisely determined the 2nd logical checkpoint, it clearly must be no later than the War of Northern Aggression, and most likely no later than the 1845 purported annexation of the Republic of Texas, which was done via Congressional Resolution rather than by a treaty as the Constitution requires. Since the President and at least 50% of the House and Senate were in on this, the legitimacy of the executive and legislative branches died by then if not sooner. However, given the benefit of hindsight, we should not be surprised if the government became illegitimate shortly after it adopted the Constitution. That is, even if you assume that the Constitution was legally adopted in the first place (despite the Articles), there seems to be no compelling reason to select a point much later than that, as we should probably want to review even the 11th and 12th Amendments, much less the later ones resulting from the War. There's no reason we can't use the same group of 13 delegates to form both the pre- and post-ratification governments, thus saving time and recruiting. We can work out other logical checkpoints later, although it could certainly be argued that the earliest one should control.

So, we need a delegate representing each of the 13 colonies. But how do we get delegates from 13 original states which no longer exist? We certainly don't want representatives of the current de facto State governments, as by now they've been thoroughly corrupted by the US government. We would need revived versions of their original legitimate States/Republics, similar to the way that we revived the Historical Republic of Texas before it merged with the New Republic of Texas to become the United Republic of Texas. To the best of our knowledge, there are no other such organizations trying to revive/recreate legitimate secular pro-liberty governments under the Non-Aggression Principle. Therefore, we will have to resort to an emergency procedure, as America's current situation is definitely an emergency. We will have to find a volunteer from each of the 13 States, who is a citizen of the USA and the State, to start such an organization from his state, dedicated to researching/recreating/reviving the original legitimate government of his state as a Constitutional Republic under NAP as we have done with the URT. He can look for more people to join his organization later on, but his organization can immediately appoint him as a delegate to the CRA.

Each of these 13 delegates will identify themselves and certify that they have started creating such organizations and that they are the delegates thereof and that their respective revived states wish to reaffirm their membership and participation in, and they will then convene as, the original United States of America in Congress Assembled (or as a Committee of the States, as appropriate) under the Articles of Confederation. They will vote to admit the URT as a new member, and I as a delegate from the URT will then join the proceedings accordingly. We'll then amend the Articles to rename our country the Constitutional Republic of America to avoid confusion with the illegal de facto regime which currently calls itself the USA. We'll also remove the perpetuity and make other suitable amendments which presently are still to be determined. We'll then take note of history and decide to legally adopt the Constitution as it was after the Bill of Rights was added but before the 11th or later Amendments - conditionally upon the creation and approval of a suitable additional document which will explain the real original intent and proper interpretation and application of the Constitution. This would be better than just staying with the Articles or adopting a different and better Constitution, because it enables us to be compatible with the other government using the same Constitution, while still providing the other needed material. We'll then delegate the drafting of the additional document to a committee which could very well consist of just myself, or if any of the other delegates have time and are interested, they may also want to be involved. Tentative plans will then be made for a future meeting to review the results and plan for the possible future dissolution of the government under the Articles of Confederation or its possible future merger into the new government under the future Constitution, and the meeting will be adjourned.

The delegates will then agree that they wish to revive the dormant original legitimate government of the United States of America as it was right after the Bill of Rights has been ratified by enough states to pass, and that they are the only living citizens they know of from their respective revived original states, and that they agree to be citizens of the newly revived America under the Constitution. They will comprise an emergency Constitutional Convention, under which they will agree that since the original legitimate American government has been taken over and they are the only remaining living citizens of the legitimate original America, the separation of powers (between the branches of government) must be temporarily suspended to the extent that they need to overlap (serve in several roles at once) in order to make quorum. They may even amend the Constitution to that effect if they feel it necessary and appropriate. Then they will each elect themselves as Governor and/or Legislature from their respective states, and as such will appoint/elect themselves as the Senator from their respective state, and then as citizens of their states, they'll elect themselves as Representatives and elect a President and maybe Vice President. They will convene alternately as House and Senate as needed to convene Congress, which will work with the President to admit the URT into the Union. The URT will then elect me to the House and Senate and then the President will appoint (and the Senate or Congress as appropriate will confirm) a Supreme Court (with me as Chief Justice). We'll then acknowledge, as the revived government under the Articles of Confederation has pointed out, the Articles are technically still in effect and that our Constitution needs to be safeguarded from misinterpretation (as we've already seen), so we'll delegate the same committee to draft the supplemental document as we did earlier under the Articles. The same (or a different) committee can also recommend which Amendments to ratify and which to reject (e.g. 16-18) and which to modify (e.g. 13-15) and also propose new ones. We might want to make some amendments right away, such as changing from USA to CRA to avoid confusion, as above. Our Supreme Court will agree with the determination of our Constitutional Convention that we can overlap branches as needed until we have enough citizens to fill all offices without overlap. We can also allow proxies, and we can certainly consider promoting the FA/DP concept for our use. Tentative plans will then be made for a future meeting to review the results and plan for the possible future merger with the government under the Articles, and the meeting will be adjourned.

Most of the delegates will probably be too busy to want to participate after this one meeting, which can be conducted via email, but they should agree at the meeting to hand over their authority to any future successor we find to pick up their organization wherever they left off. Before final adjournment, any delegates who don't plan on being active throughout the rest of this project should designate their state as unorganized territory not requiring a delegate or representation until they have a working revival organization with enough members to actively participate. That way they can avoid keeping us from having a quorum later on, and they can still participate whenever they're ready. As part of handling all this, it would be most helpful for them to name me as their proxy. After the committee has drafted a suitable document, the same governments as above (although probably with mostly new delegates, or none from unorganized territories) can review and approve the results, approve the resulting Constitution, terminate the Articles, and then merge into one combined government. Other governments based on other suitable discovered checkpoints may also be involved until they're all merged into one. Then we'll have legitimately revived the original American government with better protections of our rights, for all interested Americans to join and enjoy. We hope to grow big enough to negotiate a treaty with the current de facto regime, under which they basically just leave us alone, same as the URT.
